These Terms of Service, Privacy Policy, and Refund Policy (collectively, the "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and ROMRx LLC, an Ohio limited liability company ("ROMRx," "we," "us," or "our"), governing your access to and use of the ROMRxBJJ platform, including the website at romrxbjj.com, any associated web or mobile applications, and all related content, features, and services (collectively, the "Platform").
By clicking "I agree," creating an account, completing checkout, or accessing any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you are agreeing on behalf of a gym, school, or organization, you represent and warrant that you have authority to bind that entity to this Agreement.
You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you are 18 or older.
ROMRxBJJ is a Brazilian Jiu-Jitsu performance and injury-prevention platform that provides users with Range of Motion (ROM) assessments, Position Readiness Scores (PRS), technique eligibility analysis, individualized movement protocols, training game plan generation, drill tracking, and AI-assisted coaching tools.
The Platform is a fitness and educational tool. It is not a medical or clinical service, and it does not establish a professional relationship between ROMRx and any user.

At checkout, you will be asked to separately acknowledge and consent to the auto-renewal terms described above. This consent is required to complete your purchase. By checking the auto-renewal consent box and completing checkout, you expressly authorize ROMRx LLC to charge your payment method annually as described. You may withdraw this authorization at any time by canceling your subscription as described above.
If you are a California resident, California's Automatic Renewal Law (Business & Professions Code Section 17600 et seq.) applies to your subscription. You have the right to cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. ROMRx LLC will retain records of your subscription consent for at least 3 years as required by applicable law.
ROMRx LLC complies with ROSCA (15 U.S.C. Section 8401 et seq.) and applicable state automatic renewal laws. If any required disclosure is found to be insufficient, ROMRx LLC's liability is limited to cancellation of the subscription and a refund of the most recent auto-renewal charge only, and only where required by applicable law.
ROMRxBJJ offers digital subscription services delivered immediately upon purchase. By completing checkout, you acknowledge that you are purchasing access to a digital platform and that all sales are final.
ROMRx LLC does not issue refunds under any circumstances, including but not limited to:
ROMRxBJJ does not issue prorated or partial refunds for unused portions of a subscription period for any reason.
Subscriptions activated using a promotional code or Founding Member access are non-refundable. No exceptions.
Initiating a chargeback or payment dispute instead of contacting ROMRxBJJ directly is a violation of these Terms of Service. Accounts subject to chargebacks will be immediately suspended and may be permanently terminated. ROMRx LLC reserves the right to dispute all chargebacks by providing transaction records, consent documentation, and these Terms of Service to the payment processor.
In the rare event that ROMRxBJJ experiences an extended service outage (defined as platform inaccessibility exceeding 72 consecutive hours due to causes within ROMRx LLC's control), ROMRx LLC may, at its sole discretion, issue a subscription extension rather than a cash refund. This is a courtesy accommodation and does not create an obligation or precedent for refunds in any other circumstance.
If ROMRx LLC terminates a user account for cause (violation of Terms of Service, fraudulent activity, or abusive behavior), no refund will be issued. If ROMRx LLC discontinues the ROMRxBJJ platform entirely, no refund will be issued. Access to a digital platform is granted immediately upon purchase, and all sales are final regardless of circumstance.

You acknowledge and agree that:
Brazilian Jiu-Jitsu, grappling, and all related physical activities involve inherent risks of injury, including but not limited to: muscle strains, joint injuries, ligament tears, fractures, dislocations, and other physical harm. These risks exist regardless of skill level, fitness level, or adherence to any program.
By using this Platform, you voluntarily and knowingly assume all risks associated with:
To the fullest extent permitted by applicable law, including the laws of the State of Ohio, you hereby waive and release any and all claims, causes of action, and demands of any kind against the Released Parties arising out of or related to your use of the Platform or participation in any physical activity, even if caused by the negligence of the Released Parties.
When you create an account, we collect your name, email address, belt rank, dominant side, and gym affiliation. This information is used to create and manage your account and personalize your experience.
We collect joint measurement data you enter during ROM assessments, including measurements for hips, shoulders, ankles, lumbar spine, cervical spine, and thoracic spine. This data is used to generate your Position Readiness Score, technique eligibility analysis, and movement protocols.
Your data is processed by the following third-party service providers in order to operate the Platform:

Each of these providers processes your data only as necessary to provide the services described above and under their respective privacy policies. ROMRx LLC does not authorize any third-party provider to use your data for their own independent purposes.
We collect information about how you use the Platform, including features used, sessions logged, and protocols completed. This data is used to improve the Platform and generate aggregate analytics.
By using the Platform, you grant ROMRx LLC a perpetual, irrevocable, worldwide, royalty-free license to use, process, analyze, and commercialize your data in anonymized, de-identified, and aggregated form for the following purposes:
All data used for research, commercial use, or third-party sharing will have direct identifiers removed. Aggregate data is presented at the population level (groups of 10 or more) and will not be used to describe any specific individual. We will not attempt to re-identify de-identified data and will require third parties who receive de-identified data to agree to the same prohibition.
By completing account creation and checking the Terms of Service checkbox at signup, you expressly authorize ROMRx LLC to use your data as described in this section. If you do not wish to authorize this use, do not create an account.
The ROM assessments collected by ROMRxBJJ measure the range of motion of specific joints (hip, shoulder, ankle, lumbar spine, cervical spine, thoracic spine) for individual users. These measurements, combined with the Position Readiness Score derived from them, constitute health-related information about each user's physical condition. While ROMRxBJJ is not a HIPAA-covered entity and does not provide medical care, the FTC's updated HBNR applies to health and fitness apps that collect identifiable health information.
In the event of any unauthorized acquisition, access, use, or disclosure of individually identifiable health data:
As described in Section 7, your health data is shared with Supabase (for storage) and OpenAI (for ROMBot AI processing). In both cases, data is shared only as necessary to operate the Platform and is not authorized for use by those providers for their own independent purposes. Any commercial use of health data in aggregate form is authorized by your explicit consent at account creation as described in Section 8.
You have the right to request access to, correction of, or deletion of your personally identifiable health data at any time. To exercise these rights, contact ROMRxBJJ@gmail.com or use the account deletion feature in Settings.
Your personal data (name, email, belt rank, ROM assessments, technique eligibility, game plans, and protocol history) is retained for as long as your account is active.
When you delete your account through the Settings page, the following occurs:
To request full deletion of all personal data, including any backup copies, email ROMRxBJJ@gmail.com with the subject "Data Deletion Request." We will complete the deletion within 30 days and confirm by email.
You may request a copy of your personal data (including your ROM assessment history and PRS scores) by emailing ROMRxBJJ@gmail.com. We will provide a machine-readable export within 30 days at no charge. This right applies regardless of your state of residence.
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, to request deletion, and to opt out of the sale of personal information. ROMRx LLC does not sell personally identifiable information. For CCPA requests, contact ROMRxBJJ@gmail.com.
If you are a Virginia resident, the Virginia Consumer Data Protection Act (CDPA) grants you similar rights. Contact us to exercise them.
By using ROMBot, you acknowledge and agree that:
The limitation of liability in Section 13 and the indemnification in Section 14 apply fully and without limitation to any claims arising from your use of ROMBot or any other AI-powered feature on the Platform.
We implement commercially reasonable security measures including encrypted data transmission (HTTPS/TLS), row-level security on our database, JWT-authenticated API access, and access controls. However, no system is perfectly secure. By using the Platform, you acknowledge that data transmission over the internet carries inherent risks and that ROMRx LLC cannot guarantee absolute security.
In the event of a data breach, we will notify affected users as required by applicable law and as described in Section 9.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROMRX LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
EVEN IF ROMRX LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED, ROMRX LLC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO ROMRX LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
You agree to defend, indemnify, and hold harmless ROMRx LLC, its members, officers, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
All content, features, functionality, algorithms, scoring systems, training protocols, exercise libraries, and visual design elements of the Platform are the exclusive property of ROMRx LLC and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. The ROMRx name, logo, "Position Readiness Score," "PRS," and "ROMRxBJJ" are trademarks of ROMRx LLC. Unauthorized use is prohibited.
You agree not to use the Platform to enter false or fraudulent assessment data; attempt to circumvent any paywall or security measure; harass or harm other users; upload malware; access another user's account without authorization; use automated tools to scrape or extract data; or violate any applicable law.
ROMRx LLC reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason including violation of this Agreement. You may terminate your account at any time through account settings. Upon termination, your right to access the Platform ceases immediately. Sections 4, 6, 8, 9, 10, 11, 13, 14, 15, 17 (Force Majeure), 18, and 20 survive termination.
ROMRx LLC shall not be liable for any delay or failure to perform any obligation under this Agreement to the extent that such delay or failure is caused by circumstances beyond ROMRx LLC's reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, pandemic, epidemic, terrorism, war, government action, labor disputes, internet or telecommunications failures, cyberattacks, third-party infrastructure failures (including cloud hosting, database, AI, or payment processing providers), or any other event beyond ROMRx LLC's reasonable control ("Force Majeure Event"). In the event of a Force Majeure Event, ROMRx LLC's obligations shall be excused for the duration of the event. No refund or credit shall be owed for service interruptions caused by Force Majeure Events.
YOU AND ROMRX LLC AGREE THAT ANY CLAIM, CAUSE OF ACTION, OR DISPUTE ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE PLATFORM MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE, REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY. IF ANY CLAIM IS NOT FILED WITHIN THIS ONE-YEAR PERIOD, IT IS PERMANENTLY BARRED.
This shortened statute of limitations applies to all claims of any kind, including contract claims, tort claims, and statutory claims, to the fullest extent permitted by applicable law.
ROMRx LLC reserves the right to modify this Agreement at any time. When we make material changes, we will update the "Effective Date" at the top of this page and notify you by email or in-app notification. Your continued use of the Platform after any modification constitutes your acceptance of the revised Agreement. Notice sent by email to the address on your account is deemed received 24 hours after transmission, regardless of whether the email is opened, unless the sending system receives a delivery failure notification.
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement or the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Franklin County, Ohio. You hereby irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue or personal jurisdiction in Franklin County, Ohio.
To the extent that any other state's consumer protection laws (including California's) would otherwise apply to this Agreement, you agree that Ohio law governs to the maximum extent permitted, except where a specific state law explicitly prohibits such a choice of law provision.
YOU AND ROMRX LLC AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS PART OF ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING, TO THE FULLEST EXTENT PERMITTED BY LAW. If any portion of this class action waiver is found unenforceable by a court of competent jurisdiction, the unenforceable portion shall be severed and the remaining provisions of this Section shall continue in full force. The invalidity of the class action waiver shall not affect any other provision of this Agreement.
Before initiating formal legal proceedings, you agree to contact ROMRx LLC at ROMRxBJJ@gmail.com and provide 30 days' written notice to allow the parties to resolve the dispute informally.
